1. Who We Are

SimWizard AI is operated by Simulation Helpdesk OÜ (registry code: 14766183), a company registered in Estonia. We provide an AI assistant add-in for Simio simulation software.

2. What Data We Collect

• Account information: Email address, name, and company name (provided during registration or purchase).
• License data: License key, machine fingerprint (hardware hash), machine name, activation timestamps.
• Usage data: Token counts and request counts for billing purposes. We do not store the content of your AI conversations.
• Payment data: Processed securely by Stripe. We do not store credit card numbers or bank details.
• Lead capture data: When you submit a form on our website, we collect your name, email, company, and selected plan.

• Sending license keys and support communications
• Responding to inquiries submitted through our website
• Sending our newsletter (only if you explicitly opt in)

4. Legal Basis for Processing (GDPR)

We process your personal data under the following legal bases:

• Contract performance (Art. 6(1)(b) GDPR): To provide our software and services, manage your license, and process payments.
• Legitimate interest (Art. 6(1)(f) GDPR): To improve our service and prevent abuse.
• Consent (Art. 6(1)(a) GDPR): For newsletter subscriptions and optional marketing communications. You can withdraw consent at any time.

5. AI Data Processing

When you use the AI chat feature, your messages are routed through OpenRouter and sent to third-party AI providers for processing. These providers include but are not limited to: Anthropic (Claude), Google (Gemini), OpenAI (GPT), xAI (Grok), DeepSeek, StepFun, MiniMax, Moonshot AI (Kimi), and Zhipu AI (GLM). We act as a proxy and do not store conversation content. The list of providers may change as we add or remove models. Please review the privacy policies of the respective providers for how they handle data.

6. Machine Fingerprinting

To enforce single-machine licensing, we generate a hardware-based fingerprint (SHA256 hash of CPU ID and disk serial number). This hash cannot be reverse-engineered to identify your hardware. It is stored on our server and locally in an encrypted cache file.

8. Third-Party Services

We share data with the following third-party processors, each operating under their own privacy policies and data processing agreements:

The list of AI providers may change as we add or remove models. Your prompts and conversation data are transmitted to these providers for processing but are not stored by us.

9. Data Storage and Security

Your data is stored on Cloudflare's infrastructure (Workers and D1 database) with encryption at rest. Local license cache is AES-encrypted on your machine. All communications are encrypted via HTTPS.

10. Data Retention

We retain your personal data for as long as your account is active or as needed to provide our services. After account deletion or cancellation:

• Account and license data is retained for up to 12 months for billing and legal purposes, then deleted.
• Usage logs are aggregated and anonymized after 6 months.
• Lead capture data is retained for up to 24 months unless you request earlier deletion.

11. Your Rights (GDPR)

Under the General Data Protection Regulation, you have the right to:

• Access your personal data
• Rectify inaccurate data
• Erase your data ("right to be forgotten")
• Restrict processing of your data
• Data portability — receive your data in a machine-readable format
• Object to processing based on legitimate interest
• Withdraw consent at any time for consent-based processing
• Lodge a complaint with a supervisory authority

12. Children's Privacy

Our service is not directed to individuals under the age of 18. We do not knowingly collect personal data from children.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify subscribers of material changes via email. The "Last updated" date at the top reflects the most recent revision.
